Many of the cheater websites make a disclaimer that they are protected from Section 203 of the computer decency act. They claim they are not responsible for user generated content on their site.

Why this may not protect them?

Scraping content reposts an original content. The original user who posted content may have never visited the numerous re-post cheater sites. The cheater site would never have the content unless the website operator performed an action to generate reposts.

Some cheater sites are specifically designed for defamatory content. Some of these websites have drop down menus where a user can select a 'category'. This drop down menu is not user generated content. The website creator created this code which is not user generated it is website generated. A blank text box where a user can write their own would be considered 'user generated'. Thus only the portion of blank text box can be considered 'user generated'
